Defending Immigrant and Refugee Rights
By the authority vested in me as President by the Constitution and the laws of the United States of America, it is hereby ordered as follows:
Section 1. Policy.
The United States is a nation of immigrants, bound together by the principle that all people deserve dignity, fairness, and equal protection under the law. It is the policy of this Administration to restore humane treatment of immigrants and refugees, to expand lawful pathways to protection, and to ensure that enforcement actions are consistent with American values and international obligations.
Sec. 2. Ending Family Separation and Inhumane Detention.
(a) The policy of family separation for migrant children and parents is hereby prohibited.
(b) The Secretary of Homeland Security shall, within 30 days, develop and implement standards to ensure that children are not held in detention facilities beyond 72 hours, and that families are kept together whenever possible.
(c) Alternatives to detention, including community-based case management, shall be prioritized.
Sec. 3. Restoring Asylum Protections.
(a) The Attorney General and Secretary of Homeland Security shall immediately rescind regulations or guidance that restrict eligibility for asylum based on manner of entry, prior transit through third countries, or categorical exclusions inconsistent with 8 U.S.C. § 1158.
(b) Asylum interviews and adjudications shall be conducted in a timely, fair, and trauma-informed manner.
Sec. 4. Protecting Dreamers and Temporary Protected Status (TPS) Holders.
(a) The Secretary of Homeland Security shall take all lawful steps to fortify protections under the Deferred Action for Childhood Arrivals (DACA) policy, ensuring that eligible individuals are shielded from deportation and authorized to work.
(b) The Secretary shall review all terminated or limited TPS designations from 2017 onward and reinstate protections where lawful and appropriate.
Sec. 5. Refugee Resettlement.
(a) The annual refugee admissions ceiling shall be set at a level consistent with historical averages, no fewer than 125,000 admissions annually, subject to consultation with Congress.
(b) The Secretary of State, in coordination with the Secretary of Homeland Security, shall ensure that the U.S. Refugee Admissions Program is fully funded, staffed, and capable of meeting this target.
Sec. 6. Oversight and Transparency.
(a) All agencies implementing this Order shall provide quarterly public reports on asylum processing times, refugee admissions, and family reunification efforts.
(b) The Office of the Inspector General for the Department of Homeland Security shall conduct annual reviews of detention conditions and publish findings.
Sec. 7. General Provisions.
(a) Nothing in this Order shall be construed to impair or otherwise affect:
(i) the authority granted by law to an executive department or agency, or the head thereof; or
(ii) the functions of the Director of the Office of Management and Budget relating to budgetary, administrative, or legislative proposals.
(b) This Order shall be implemented consistent with applicable law and subject to the availability of appropriations.
(c) This Order is not intended to, and does not, create any right or benefit, substantive or procedural, enforceable at law or in equity by any party against the United States, its departments, agencies, or entities, its officers, employees, or agents, or any other person.
